Terms and Conditions

1. SUBJECT AND NATURE OF THE AGREEMENT: The present agreement is stipulated between Varitiez dba Aprende Ingles, Computer Services, Database Designs, Graduate, Lucy's Jerky, Shoppers, and Website Designs the "Companies" who is engaged of providing different types of services. Client agrees to be responsible for all Invoices, estimates, and charges on his or her account if not paid with thirty (30) days of completion account will be terminated and thirty (30) days after termination date account will be turned into a legal action. Company reserves the right to assess additional fees in the event of payment being late.

2. EXECUTION OF THIS AGREEMENT: This agreement may be executed between the client and a company representative present at the company. All information acquired will be considered integral part of this agreement for the purposes of verifying the clients identity and personal information.

3. VARITIEZ ACCOUNT #: Upon acceptance of this agreement by both parties, company will provide client with a numbered welcome letter that will allow access to all Varitiez departments with a Security Answer/Password that the client sets.

4. PAYMENT TERMS: Purchases are to be paid with Cash, Check, Credit/Debit Card, or our Financing Option also known as a "Loan". All departments require amount to be paid in full before services/results are rendered to customers.

5. PRIVACY: All information provided to the company by client will be kept strictly confidential. Any information regarding the use of clients account may be provided to client upon request all transaction records and payments.

6. ACCOUNT REQUIREMENTS: By applying for a Varitiez Account client provides valid documentation showing they are at least 18 years of age. Company reserves the right to refuse an account/membership to any applicant at its sole discretion.

7. BREACH OF AGREEMENT: Company reserves the right, at its sole discretion, to cancel the clients account with the company due to breach of this agreement.

8. CANCELLATION DUE TO INACTIVITY: If clients account remains inactive for a period of six months, Company may deactivate the account.

9. GOVERNING LAW: This agreement shall be governed, interpreted, and enforced in accordance with the provincial and federal laws and shall be subject to the jurisdiction of state.

10. PREVIOUS LEGAL ACTION: Will be looked over carefully by Varitiez Board and or CEO if approved may result in a penalty payment.

11. DISCOUNTS: Varitiez offers a variety of Discounts to its Account Holders. The discount percentage is not to exceed the percentage of 23% when adding all percentages from each discount.

12. CHANGES IN THE TERMS AND CONDITIONS: Terms and Conditions will and can change in time with little or no notice to the customer. It is the responsibility of the customer to ask for or visit our Terms and Conditions page at www.varitiez.com/tnc.

13. UPDATING ACCOUNT: It is the responsibility of the client to make sure that all the information given to Varitiez is all accurate and correct. Only the Account Holder may update the account information/make changes.

14. ACCOUNT HOLDER: An Account Holder is the person responsible for paying all invoices and person who applied for a membership/account with Varitiez.

15. AUTHORIZE AND THE TERMS AND CONDITIONS: An Authorize is a person on the account allowed to add invoices and estimates to an account. All authorizes must follow and obey the terms and conditions as well. It is the responsibility of the account holder to ask and get a copy of the Terms and Conditions to each authorize. Their is no age limit required because the Account Holder is authorizing him or her to add invoices to the account.

16. PHOTOGRAPHER RELEASE: If at some point in time we are to take a picture of you or our services you hereby grant permission, on a permanent basis, to Varitiez and its departments to use the photographs taken for Varitiez and its department's publication and website.

17. PROMOS/COUPON: Using a Promo/Coupon is one per transaction. Coupon/Promo must be surrendered at the time of purchase by customer or mentioned on phone/chat orders prior to being submitted. Promo Code must be given to a Varitiez representative. May not be used for prior purchases or sale priced items or combined with any other coupon, promo, offer, or sale. May not be used to purchase shopping cards, gift cards, gift certificates, or in store parties.

18. REFUND: All sales are final. Company can only issue store credit by a gift certificate that can not be redeemed for cash.

19. FINANCING OPTION: This option allows you to receive our services without having to pay up front. We will finance the transaction known as a "Loan". Financing a transaction will require that a Social Security Number be on file. The terms of this loan include:

a. INTEREST: The Interest rate is 25%, that can change in time. This rate will be disclosed to the client at the time of talking about getting a loan.

b. RENEW: Clients will have the option to renew the loan agreement however it will be refinanced on the current interest rate at that time.

c. LENGTH OF LOAN: Loans can be set up for 2 months or more so the minimum payment is set per customers preference. The first financed transaction will be set with a minimum of ten (10) months.

d. PAYMENTS: Payments are made on a monthly bases. These payments vary depending on the length of the loan. Late payments will result in Late fees. The minimum payment must be met each month regardless if a larger payment was met the month prior.

e. LATE FEES: Late fees are $25.00 per day that goes on without making a payment.

f. PENALTIES: There will be a $100.00 fee added to your loan in the event you exceed the length of loan.

g. DUE DATES: The due date will be the day the transaction is financed and billed to the client. Payments can be made online at www.varitiez.com/pay via chat, phone, or text. You also have the ability to set up automatic withdrawals.

h. END DATE: Once the contract ends and there is a balance remaining on the transaction Varitiez will ask the client to renew if the client chooses not to renew a contract. Varitiez reserves the right to disconnect the website and or Database.

i. DEFAULTS: Once a payment is missed the website or database will be disconnected. Payment plans can not overlap another payment plan so if minimum payment is not met and no interactions reflect attempt to contact Varitiez to inform that payment will be late the site will be disconnected. If you let us know in advance that a payment will be missed late fees still apply but the site will not be disconnected until the promise to pay date.

1. CREDIT: Varitiez only reports to the three major credit bureaus when a transaction defaults for 31+ days. This does not require a credit check and we will not report to the credit reporting agencies of payment history only when an account goes delinquent for 31+ days.

j. ADDITIONAL TRANSACTIONS: Once a financed transaction is billed any additional changes or transactions will have to be on a new transaction. Those would either have to be paid in full or financed on a different loan. That transaction will follow these terms on its own merits. All financed transactions per one account can not exceed three thousand dollars ($3,000.00). If this number is met transactions will have to be paid off before more transactions can be financed.

k. DEPOSITS: In some cases if the financed transaction is a large amount a deposit may be requested or negotiated between the client and company.

20. MONTHLY WEBSITE DESIGNS: Are a monthly charge to allow the client to stack transaction of designs/edits to the website and get billed at the end of the month for them but allows them to be live immediately. The Monthly website design cost is $25.99 a month and is to be paid for a minimum of one year. Monthly website design plans cant not be transferred to another domain name and any months that there was no changes will not be credited or refunded.

Once the month ends and an invoice (transaction) is sent to the customer they will have to either pay the full invoice off or finance the transaction. Failure to do so will result in the removal of the coding that was not paid for or the entire website being deactivated if financed.

21. MONTHLY DATABASE DESIGNS: Are a monthly charge to allow the client to stack transaction of designs/edits to the database and get billed at the end of the month for them but allows them to be live immediately. The Monthly database design cost is $25.99 a month and is to be paid for a minimum of one year. Monthly database design plans cant not be transferred to another database and any months that there was no changes will not be credited or refunded.

22. LICENSING AGREEMENT: Is a binding contract between the customer and Varitiez. It is to be paid in full for the amount of the contract. These terms are in months. The customer decides the length of time (months) for the contract. The customer buys the existing database however the information following the Lock screen belongs to Varitiez and its affiliates. The terms of this contract include:

a. PAYMENT: The payment for the license is to be paid in full for the length of the contract.

b. RENEW: Clients will have the option to renew the contract agreement however it will be on the contract terms at that time.

c. LENGTH OF AGREEMENT: Agreements are set up for 1 year or more. anything less the customer buys out right.

d. PAYMENTS: Payments are to be made in full at the time of signing the agreement.

e. PENALTIES: There will be a fifty six percent (56%) fee of the remaining contract plus two hundred dollars ($200.00) added to the clients agreement in the event they end the contract before the contracted time.

f. DUE DATES: The due date will be the day of signing the contract. Payments can be made online at www.varitiez.com/pay.

g. UPDATES: Updates to the database will be done thought the time of the contract without an end date. We will complete requests on a timely manner and if the contract is over and the client wants an up date the client will pay the rate for an ended contract for the update.

h. END DATE: Once the contract ends Varitiez will ask the client to renew if the client chooses not to renew a contract. Varitiez reserves the right to disconnect the database and or Website.

23. MARKETING: By giving us a cell number, a number later converted to a cell number, or an email address, you agree that we can contact you at this number by auto dialer, recorded or artificial voice, or a text. Your phone plan charges may apply.

a. OPTING OUT: You can opt out of these marketing calls, emails, or text messages at anytime and only be contacted for the protection or collection of your account. You must notify a Varitiez representative by filling out our online form at www.varitiez.com/unsubscribe.

24. TRIAL DATABASE: By downloading a Varitiez database in trial version you agree that we may disconnect/discontinue the database at any time. These databases usually will have an expiration date of 30 days. Varitiez reserves the right to discontinue/disconnect the database at any time at its sole desecration. These databases are to be used to practice and provide feedback on how we can improve.

a. TRIAL PERIOD: The database will be active for 30 days and after you will have the option to download another database or purchase your current database without losing any of your data you entered.

b. Splash Screen: Is the initial screen that come up it is labeled as the Lock Out screen. This screen allows us to shut down the database when needed. This is usually when the database is leased and not purchased out right. Click on the Continue button and it will take you to the Log In Screen. If you do not see a continue button you will have to contact us as this is usually an indication that payment is needed.

c. PRE-SET USERS: You can add more users if you would like in the employee section. For now we have loaded all databases to have two users. It has a "Training" username that the password is "t1" and an Administrative user that is "Admin" password is "varitiez02" passwords and usernames are not case sensitive. Newer versions like Store, Salon, and Restaurant have the training with the same password however the admin password is "123456".

d. VARITIEZ LOGO: There is the Varitiez logo on the bottom right of the log in screen allowing you to get help/assistance from a Varitiez representative and or contact information for us.

e. COMPANY INFORMATION: Company information can be updated via the Admin Tab on the Main Screen. You will click on the Company Information and change to be your company information. Not all databases will have this option.

f. ANNOUNCEMENTS: The Announcements Tab on the Main Screen is to be used to give feedback on the database and or to list questions/comments regarding the database. Keep in mind that this is a public comments/questions section and will be shared with any company that has our database built in. These comments/questions are to be listed in a professional manner only. Any inappropriate comments or questions will be deleted and user may be discontinued from the database and any future downloads. By submitting on this online form it will post on our website and in all our databases. You here by give us permission on a permanent bases to use this information. Not all databases will have this option you cant visit www.varitiez.com/blog to view it online.

g. ALTERATIONS: There is to be no alterations to any databases that are downloaded. This is a strict violation of privacy and legal rights. Any one found to violate this policy will be prosecuted to the fullest extent of the law.

h. REQUIREMENTS: In order for our databases to work on your computer you must have Microsoft Access or Microsoft Access Viewer installed on your PC. These databases only function on computers or laptops. They will NOT work on Cell phones, Smart phones, or tablets. You must have a screen resolution of 1360 x 768 or greater. Anything less will result in an incomplete screen. You can download a free copy of Microsoft Access for free by clicking here. Because each database is a trial you will need to have internet access in order to get past the splash screen.

25. WEBSITE AND DATABASE DESIGN CONTENT: Varitiez does not support nor does it verify the content of the website(s) it creates. We are hired as a third party company, to program and design a website and or database. We are provided the content (wording, images, links, and or services). We are not affiliated with any one company and its use, unless defined in our Affiliates. We may use the content and or the site for the use of our portfolios.

a. SUGGESTIONS / RECOMMENDATIONS / PLACEHOLDERS: At times Varitiez may suggest, recommend, and or place placeholders on the clients website for appeal and or look of the site. It is up to the clients discretion if this/these item(s) remain and or get removed from the site. This includes but is not limited to content, images, links, icons, etc.

26. REMOTE ACCESS: Varitiez has technology to remotely control your PC when granted permission. We would have to be in a live Virtual Meeting in order for us to control your PC. This control is usually only used when the client needs assistance with a database and or tech issue on their PC. We will walk you through the steps before we try and control the PC.

a. PRIVACY: Varitiez respects you and your company privacy which is why when you grant us access to remotely access your PC we will only be there in a tech support role. We will not access nor edit any documents that do not have a business purpose.

b. HOW IT WORKS: In order for us to control your PC you must download an application that can be found at www.varitiez.com/remote or you can Click Here. Once permission is granted and app is downloaded we will be able to see everything on your screen and be able to access documents and systems on your PC. This control will only be used to help with the issue at hand.

c. AFTER SUPPORT: After we have completed the support needed to get your station up and working you can delete the application that was downloaded or keep it. By having the application on your PC does not allow us access to your PC you have to grant us permission to do that. By keeping it, it will allow quicker access in any future support that is needed for us to access your PC.

27. CONSULTATION: Varitiez offers two forms of consultation when it comes to presenting the designs and they are as follows:

a. IN PERSON: Varitiez offers the traditional meeting of in person to discuss your design ideas. We will meet at the clients choice of location to review the designs, ideas, and final product.

b. VIRTUALLY: Varitiez is proud to also offer virtual meetings were we meet with clients in a virtual room online to discuss your ideas. When meeting virtually we will display our screen to give you visuals on the content we would like you to see. (Usually your designs) During these meetings you will have audio, mic, and visuals to hear us talk with us and see what we are seeing.

28. COVID19: Varitiez has practiced all the following but because of COVID19 concerns we wanted to let you know how we are keeping you safe during this and all the time.

a. SOCIAL DISTANCING: Varitiez has rarely consulted in person unless instructed by you. During COVID19 we will not be consulting in person and only be discussing your designs via Live Chat, Email, Phone calls, or virtual meetings. (Please see 27.b on our Terms & Conditions)

b. TECH SUPPORT: In the event that you need assistance with a database and it requires us to control your computer. We offer Remote Access that allow us to access your computer remotely and control your PC and documents. For more information on Remote access please see line 26 on our Terms & Conditions.

29. WEBSITE DESIGN COST: Varitiez has two costs when it comes to the website designs. They are as follows:

a. HOSTING/REGISTRATION: This charge is a yearly cost that will register your website on the World Wide Web (WWW). This registration also makes the domain name yours and no one else in the world can use. We offer three options when it comes to the hosting/registration package you choose, they are as follows:

a. WWW.YOURDOMAIN.COM: This option is $14.09/month that must be paid for full year. Discounts available if registration is more than one year, registration is in year increments. This option is also the only one that offers unlimited emails and online databases.

b. WWW.YOURDOMAIN.VARITIEZ.COM: This option is on a shared server that can slow down the servers as its shared with multiple pages. This option is $7.05/month that must be paid for full year. Discounts available if registration is more than one year, registration is in year increments. Does not include emails and online databases.

c. WWW.VARITIEZ.COM/YOURDOMAIN: This option is on a shared server that can slow down the servers as its shared with multiple pages. This option is free of charge for registration however all users must visit varitiez.com forward slash your domain name. These sites can be taken down at the companies sole discretion and server speed is prioritized to varitiez.com as that is the domain that is registered. Does not include emails and online databases.

With all above options you will get Domain Privacy meaning your personal contact information remains private to Varitiez and its affiliates. You will also get Secure Sockets Layer (SSL) which is a security technology that is commonly used to secure server to browser transactions. This generally includes the securing of any information passed by a browser (such as a customer's credit card number or password) to a web server (such as an online store or online banking application).

b. DESIGN COST: The cost for designs is hard to get a clear understanding as it depends on coding, time and design however on average the cost for a custom built site could be as low as $0.01 per character in the design code.

30. SECURITY: Both website and databases designed by Varitiez will be secure and protected. For Website Designs we protect the site by providing Secure Sockets Layer (SSL) which is a security technology that is commonly used to secure server to browser transactions. This generally includes the securing of any information passed by a browser (such as a customer's credit card number or password) to a web server (such as an online store or online banking application). For Database Designs we protect the database by ensuring they are a local database and not accessible online. Most databases are password protected for end users to access content. We also have a splash screen that can be disabled at any point in time via remote access for splash page.

31. WEBSITE DESIGNS: The following is in general terms regarding website designs.

a. CONTENT ACCESS: Once content (transaction containing content) is paid for it is the property of the client and can be used or transferred as desired. When it comes to transferring or moving to a new host/provider it is the responsibility of the client to ask for and do what they would like with the coding. If the website registration expires and the site is taken down the content will be erased and will no longer be able to be recovered. A Minimum of 30 days prior to expiration of registration must be given to the company to be able to provide client with the coding of the website. If request is not made or we are past the 30 days the content could be erased and no longer recovered without notice to the client. It is the responsibility of the client to advise Varitiez what to do with the content when the intent is to no longer continue hosting plan.

b. EMAIL: Emails that are registered with domain name are the property of the client and are maintained by Varitiez. Once registration is no longer with Varitiez the contents and email is lost.

a. NEW or the REMOVAL of an email is requested it will be submitted to Varitiez via email, online form, chat, or call. Varitiez will have 24 business hours to get email registered or removed. (Weekends are not considered business days.)

b. Checking Emails Emails use POP3 and STMP services when it comes to using 3rd party platforms like Outlook. You can have your IT admin program these or we can walk them or your thru the steps. You can also check your email via the hosting email site by clicking here or visit varitiez.com/email.

If you forget your password and need it reset you will contact Varitiez via email, online form, chat, or call. Varitiez will have 24 business hours to get you a temporary password. (Weekends are not considered business days.)

c. UPDATES/MAINTENANCE: Will be sent to Varitiez via email, online form, chat, or call. Depending on the design and complexity of the site. Rough estimates would be:

Simple corrections or additions like adding a word, sentence, paragraph, or image would be within 1-2 hours of receiving request. (This is based on you getting us content in electronic form. Us having to come up with the content and or electronic copy can increase the time.)

If the design is straightforward, and the implementation is also straightforward, then allow 8 hours for design and 8 for development for each page. So the front end of the site would take 64 - 96 hours to complete. If it's more complicated, allow 16 - 24 hours each for design and development per page.

Because Varitiez does not charge until the design is approved by the client, once a design is paid for any corrections, changes, alterations, to the existing site will be considered an update or maintenance and would result in a charge if not on a monthly plan.

d. PROGRAMMING: You will not be required to learn or know how to program. We will program everything on the site and if you move your website to another host we will provide the code to you at your request.

e. DOMAIN NAME: The Domain name will be registered to your information and will belong to you. You can move it to any location you would like if you no longer host it with us. If your registration lapses the domain name will no longer belong to you and anyone can purchase/register that domain name. Domain registration is with a third party registration and will be registered to Varitiez, Varitiez only facilitates the registration process and will complete it for you on your behalf unless you request other wise. If you register the website with another provided the results of the content can vary as we are not familiar with their platform and options. An example we offer unlimited email addresses and online databases for blogs but your plan may not include that if you go with someone else.

f. MONTHLY ACTIVITY: We do not offer monthly activity changes however we do offer Website Monthly Design plans for updates and maintenance to be billed at the end of the month all at once vs each change being a transaction and being billed, please see line 20.

g. TIME FRAMES: are dependent on the design and complexity of the site. Rough estimates are:

h. ROLES: The clients role is to provide us the idea and or content for the website and the companies role is to design the idea or layout of the page. Once you have provided us the idea and we create the site it will be your role to give the final approval of the look and content. Once approved we will make it live when payment is received for the design. If the design is live but payment is not received in a timely manner it will be removed from the site and the registration cost can not be refunded. If the transaction is financed please see finance section of this page.

32. PAYPAL/PERSONAL ACCOUNTS: We will not ask you for access to PayPal accounts or your personal accounts. In some cases like online shopping carts it requires you to provide us coding that your provider offers. We can walk you through the steps and or help with instructions on how to obtain this information however we will not ask you to provide information like username and or password. If you decide to ask us or provide us the information we will send you an email with the following message that you must agree to in order for us to access the page. We are not responsible for any changes alterations or edits, transactions etc while we are in there which is why we record the interaction.

You authorize Varitiez and its staff to access your PayPal account with the purpose of assisting you with setting up Shipping fee. You have provided your email and password freely and it was not asked nor will be stored by Varitiez and its affiliates. This one time access will be recorded and monitored by Varitiez to ensure that we went in with one purpose listed above and prevent any unauthorized access please reply to this email with you agreeing to the above statement.

33. Non-Discounted Charge: We have included a price on transactions that will be called the Non-Discounted Change or NDC for short. This charge will be a percentage of 3.49% of the transaction total after discounts and an additional $0.49 for every payment made. These charges are a combination of fees we are accessed in relation to using some third party systems. These fees will now be applied to all transaction and the percentage will be after discounts and taxes.
